Jan. 6 Committee: Tell the DOJ to prosecute

The January 6 Congressional Committee has amassed a complete and damning case about Donald Trump's wide-ranging criminal conspiracy that led the deadly insurrection. The Committee should take one more step: Formally make a criminal referral to Attorney General Merrick Garland of the crimes they have uncovered.

Why is this important?

Donald Trump helped instigate the deadly assault on the Capitol as he desperately sought to overturn the 2020 presidential election results. As the bipartisan January 6 Congressional Committee has presented, Trump and his closest conspirators knew they had lost the election, but did anything they could to stay in power regardless.

The committee has done important and compelling work bringing to light the truth about this historic and horrific set of events. But they shouldn't stop there. While it's critical we all learned the truth, we now have to act on it—and prosecute Trump and the members of his inner circle who were central to this coup attempt. While the Attorney General will make his own determination of the case, if the committee has found legal wrongdoing, they should say so explicitly by formally handing over their findings and conclusions for the DOJ to take up.

If we don't prosecute Trump, then coup following the 2020 election will only be a rehearsal for a next one—as people will see there are no consequences for attempting to overturn our elections.

The committee should make a formal criminal referral to Attorney General Merrick Garland so the full force of the Justice Department is brought to hold Trump and others accountable for these treasonous and deadly acts.
