CSUN Needs More TreesThe campus of California State University, Northridge needs more trees and shaded spaces as temperatures in the San Fernando Valley continue to rise. The Valley already experiences extreme heat, with summer temperatures often exceeding 100°F during heat waves, and research shows that the greater Los Angeles area has warmed over time and could heat up by another 4 to 5°F by mid-century. Climate projections also suggest that the number of extreme heat days in the Valley could increase dramatically in the coming decades, making hot conditions more frequent and more intense. At the same time, urban development has replaced natural land with concrete and asphalt, which trap heat and make outdoor areas feel even hotter. Studies show that increasing tree cover can reduce temperatures by several degrees, while shaded spaces can make a significant difference in how hot it feels. Without more trees and shade, CSUN students will have to deal with increasingly uncomfortable and potentially unsafe conditions as the climate continues to warm. Abolish U.S. Court of AppealsThis petition is to demand Congress abolish the U.S. Court of Appeals for the Federal Circuit (Appeals Court). Taxpayer dollars were used to establish a formidable Jim Crow network within the Federal Circuit that uses institutional racism. The Jim Crow network could not exist without the protection of the Appeals Court. Appeals Court judges knowingly and willingly lied to defend and preserve the use of taxpayer money for institutional racism. This court was created by Congress with passage of the Federal Courts Improvement Act of 1982. Congress appropriated about $32.5 million dollars in FY 2012 to operate this court. The $32.5 million could be better spent by providing about 125,000 head start children breakfast for about 260 days a year. Congress last abolished a court in 1913. It is about a 5-minute exercise for Congress to verify the Appeals Court judges lied to defend and preserve using taxpayer dollars for institutional racism. The law: Federal statute § 838.101; (2) in executing court orders under this part, OPM must honor the clear instructions of the court. State Court order: I was entitled to 50% of the 47.38% in retirement benefits the order stated I earned between 08-05-78 and 11-08-92. The order classified these benefits as community property retirement benefits. The order stated I was entitled to 100% of the separate property retirement benefits, defined as the retirement benefits I earned before the date of marriage (08-05-78) and after the date of separation (11-08-92). Numbers used by OPM to calculate and apportion my retirement: The Appeals Court Opinion: A GOOGLE search of United States Court of Appeals for the Federal Circuit case 2007-3090 HORACE M. CHAMBERS, Petitioner, v. OFFICE OF PERSONNEL MANAGEMENT: BACKGROUND The source of Mr. Chambers’s complaint is an order by the Superior Court of California issued in connection with his divorce from Patricia Chambers. The court awarded Ms. Chambers 24 percent of Mr. Chambers’s gross monthly annuity under the Federal Civil Service Retirement System, and directed the Office of Personnel Management (“OPM”) to pay that portion of the annuity directly to Ms. Chambers. OPM found that the order was acceptable for processing, and it began sending Ms. Chambers a 24 percent share of his annuity payments The above wording by the Appeals Court clearly provides the Jim Crow process used to defend and preserve using taxpayer dollars for institutional racism. The Jim Crow network works as a team and tells the same lie to defend and preserve institutional racism. My complaint was that OPM should have rejected the state court order because it was not in accordance with Federal statute or honor the instructions for both parties as provided by Federal statute. The Jim Crow network falsely states what my complaint is in order to conceal the racist act that already occurred. I could care less what they paid ex-spouse, if it was not illegally taken from me. In accordance with the state court order I was entitled to 23.38% of the community property (47.38% - 24% to ex-spouse) and a little over 35% in separate property interest rather than the 16.04% actually used by OPM. The Jim Crow team intentionally excluded the law and the time periods specified in the state court order in order to subject me to institutional racism. Federal statute provides that I earned 1.5% for each of the first 5 years of service, 1.75% for the each of the next 5 years and 2% for each year thereafter. The court order stated that I earned 47.38% in community property retirement benefits between 08-05- 78 and 11-08-92. The 47.38% was accepted and used by the entire Jim Crow network even though by Federal statute I earned about 28% during the specified time period. In sum, these are the taxpayer funded oversight agencies that have banded together to practice, defend and preserve use of tax payer dollars for institutional racism. The individuals within have willingly and knowingly lie because there have never been any adverse consequences. Meaningful Gun Control - Comprehensive PlanWhile many people have crafted worthwhile petitions demanding action after the murder of 26 people in Newton, Connecticut, this petition serves to put forth a comprehensive plan to take the action so many are demanding and hopefully contribute to the dialogue and initiative that Vice President Joe Biden has engaged in this week. Here are some ideas. I hope they will be helpful. 1) Changes to Firearms Regulation: a) Eliminate the sale and circulation of all automatic and semi-automatic assault rifles and any other weapons that cannot be legally used for hunting. They are designed for one purpose, killing people; b) No person should be allowed to own an automatic weapon of any kind (pistol, shotgun, rifle, etc.); c) No civilian should be allowed to own or possess a military weapon of any kind (pistol, rifle, AK-47, hand grenade, etc.); d) Eliminate and prohibit the sale and distribution of all ammunition for those weapons; e) Enact significant penalties for any dealer, retailer or individual who sells or distributes such weapons ; (see below) f) Enact a hefty federal firearm tax (20%), akin to the cigarette and gas taxes, making gun owners responsible for paying for any of the measures and programs required to facilitate their gun ownership; g) Offer federal tax, rebate, or grant incentives for schools that install access control panels (similar to those found in many government and other professional buildings) to prevent access by unauthorized persons. 2) Mental Health Assessment and Treatment: a) Similar to the mandatory, confidential reporting of any suspected child abuse by public teachers and officials, there should be a similar, confidential requirement for reporting suspected mental illness in students. i. Anyone who is reported must undergo a thorough psychiatric evaluation and be required to participate in all recommended interventions and recommendations; ii. Once a person has been reported, the person and all relatives must turn in all weapons they possess until the person has been either cleared by the psychiatrist or assigned to an inpatient facility; iii. All reporting and subsequent investigation shall remain confidential and not appear in any type of publicly-available record, permanent or otherwise. b) Funding for mental health facilities must be increased and additional annual training for therapists must be a mandated part of their certification and recertification. 3) Suggested Punishment/Consequences: a) Any person who makes a reported threat to do violence must: i. Undergo thorough psychiatric evaluation and be required to participate in all recommended interventions and recommendations; ii. Serve a minimum of 1 year of jail time if the threat is determined to not be genuine (no parole); iii. Serve a minimum of 5 years in prison and with extensive psychiatric therapy if person is determined to be a genuine threat (no parole); b) Any person perpetrating a crime with a gun when it is not discharged – 10 years in prison (no parole); c) Any person perpetrating a crime in which a gun is discharged – 20 years in prison (no parole); d) Any person perpetrating a crime in which someone gets shot – 40 years in prison (no parole); e) Any person perpetrating a crime in which someone is killed – life in prison (no parole); f) Anyone, dealer, retailer or individual who sells or distributes illegal weapons; iv. Their store/business is closed; v. 1st offense – 5 years in prison (no parole); vi. 2nd offense – 10 years in prison (no parole); g) Dealers or individuals selling or distributing weapons without proper background checks – same penalties as #5; h) Any person who commits a crime that involves the use of a weapon must be sentenced to jail time and therapy and not be allowed to possess or own a gun from that time forward. 4) Gun Education In addition to regulations that must be met in order to procure a gun permit, all gun owners must participate in a comprehensive educational program related to gun safety annually. It has been postponed in order to find an exceptional speaker who can push our leaders to take action on steps needed to commit to and fund a comprehensive active transportation plan that can help us meet our climate goals and achieve a bikable, walkable, livable, city for everyone. It is past time for Sacramento to commit to and fund a comprehensive active transportation system that prioritizes safety, addresses inequities, reduces air pollution, reduces traffic congestion, decreases the cost of transportation, and creates a vibrant, livable city. Now is the moment to demand for these changes with an influx of Federal funding arriving in Sacramento. WE NEED YOUR VOICE! In its final report, the Mayors’ Commission on Climate Change recommended that to achieve its climate goals, Sacramento must prioritize the use of active transportation, public transit, and shared mobility services, and then electrify remaining vehicles. Reducing vehicle miles traveled by prioritizing walking, biking, rolling, and transit is the most effective way to reduce emissions in Sacramento. We are asking the Sacramento City Council to: 1. Build a Comprehensive Active Transportation Network. Commit to and take action to build a seamless, low-stress network of active transportation corridors, for the central city and connections into and out of the city. An infrastructure that supports safe walking, biking and rolling should include the following elements: separated bikeways, secure bicycle parking, adequate lighting, widened sidewalks, traffic calming, and other speed reduction measures. 2. Commit Funding. Prioritize and set aside funding within the city budget for an active transportation program. Set aside the necessary matching funds to qualify for the federal and state infrastructure programs this year and in future years. Deliberately seek additional funding and financing through grants, state and federal programs, and other revenue sources. 3. Adopt Policy Guidance to Reduce Vehicle Miles Traveled. All land use decisions should require consideration of reducing vehicle miles traveled when new projects and modifications to existing projects are evaluated by staff and reviewed and approved by City Commissions and Council. 4. Focus on Equity. Prioritize a consistent focus on equity for project timing and funding. 5. Engage the Community. Engage the community and regional experts in developing an active transportation program that works for everyone. 6. Ensure Adequate Staffing.
