Protect Virginia Families: Pass the Parental Rights Bill

Some of Virginia’s parents are being unfairly punished for doing something that is completely legal, using marijuana, methadone, or other prescribed medications. Families are being torn apart, not because of abuse or neglect, but because of outdated laws that treat the legal presence of these substances as automatic evidence of unfit parenting.

Virginia law already recognizes marijuana as legal for adult use and methadone as a life-saving treatment for people in recovery. Yet our family courts still operate under old assumptions that equate any substance use with danger. Parents who are managing pain, maintaining sobriety, or using cannabis responsibly should not have to choose between following the law and keeping their children. That’s why we’re demanding action.

Why is this important?

The Parental Rights Bill is a simple, common-sense fix. It aligns Virginia’s child welfare laws with current state policy — protecting families while keeping safeguards for real cases of neglect or harm. This bill ensures that legal, responsible behavior is not mistaken for abuse, and that recovery is supported, not punished.

For two years in a row, this bipartisan bill passed both chambers of the General Assembly with overwhelming support — only to be vetoed by the Governor. We can’t let politics continue to harm Virginia families.
