Respect Justice Ginsburg’s Legacy: No Rushed Senate Confirmation

The American people deserve a careful and transparent vetting process. A rushed confirmation before the election or during the lame duck Senate session will only further undermine the legitimacy of the Supreme Court.

The Senate must not rush through a confirmation this year-- and should only fill Justice Ginsburg’s Supreme Court seat after a thorough, complete, and rigorous confirmation process.

Why is this important?

We’re shocked and heartbroken by the passing of Justice Ruth Bader Ginsburg, a true champion for our democracy and rule of law.

As widely reported, just days before her death, Justice Ginsburg dictated this statement to her granddaughter Clara Spera: "My most fervent wish is that I will not be replaced until a new president is installed.”

President Trump and Senate Majority Leader McConnell should honor her wish.

But unfortunately, we must prepare for the possibility that President Trump and Mitch McConnell to rush through a Supreme Court nomination -- abdicating their constitutional duty to thoroughly vet any nominee in order to fill Justice Ginsburg’s seat before the election.

In fact, earlier this year, McConnell said that he would reverse his posture from 2016, and that he would confirm a Supreme Court nominee in an election year. And just weeks ago, President Trump released a list of possible nominees in an attempt to fire up his base.

We’re demanding that senators use all means at their disposal to do their constitutional duty, and ensure a thorough, careful, & transparent vetting process.

With the Senate adjourning in two weeks, they still need to pass a continuing resolution to fund government, as well as pass coronavirus relief that will properly fund local governments, election security, and the Postal Service.

There is simply not enough time for the Senate to conduct a rigorous confirmation process in addition to those urgent, necessary priorities. And, a rushed confirmation process at their expense would only undermine the Senate and the Supreme Court’s legitimacy in the eyes of the American people.
