Landlord Accountability ACTIt is a most unfortunate thing that in these the United States of America, tenants or renters, do not enjoy the same freedoms or privileges as home owners. Therefore they are often not treated with the same level of respect as a home owner. This even though the Constitution says that all people have the right to the same quality of life. The Constitution does not say that home owners are better than renters. Many of which would love to own a home but to whom it will never be a reality. Millions of innocent renters have their rights abused every year, and the unfortunate thing is, it goes unreported to the Federal Government. It is estimated that 65% of the U.S population are renters, and America's renters are getting fed up, with landlord rhetoric. I therefore on this 8th Day of September 2011 institute the Landlord accountability act. The law will require landlords once and for all to be legally accountable for the acts of their tenants in relation to their respective properties. To answer to the law and their renters for not enforcing rules and laws on their respective properties, and for committing slander or illegal evictions against their tenants. If passed in the Senate and House and signed by the president, this bill will become Federal law in all 50 states of the U.S. Making landlords fully accountable. Below is the provisions of the bill: *Give law abiding renters many of the some rights as home owner, with regard to their quality of living. Does not include real property rights. *In respect to small business: Landlords shall charge small business a responsible rent fee. It shall be a violation of this law for commercial landlords to charge above what is considered legally responsible. *This law entitles all law abiding persons in the United States, who have proof of citizenship or residency, to decent quality housing in the 50 states. Landlords will be required to ask for proof of citizenship, or residency when a prospective tenant files an application. All rental applications must be on file at a state level with the local housing authority agency. *Making landlords legally accountable to State and Federal governments for failure to enforce rules on the respective properties, including mandatory jail time for allowing illegal activities to happen knowingly on such properties. This includes failure to enforce no smoking laws, noise, drugs and any other activity which violates the human rights of fellow tenants. *Would require landlords to view tenants as a customer, rather than a renter, and would require landlords to accommodate tenants as a regular customer. Landlords would be required to afford all the same rights to tenants, as if they were a home owner. Again this excludes real property rights. Landlords cannot sue or file charges against tenants for repairs made by the tenant, if landlord fails to properly maintain rental unit. *Known landlord slander, and false accusations issues against tenants, could carry a possible jail sentence of at least three months for landlords. The courts could convict if the tenant has three or four witness. Which would also be considered viable evidence in court. Photos and evidence may be requested by the presiding judge. *The maximum length of a legal rental lease agreement would be reduced to six months. Thus giving tenants more control over their living situation. Tenants will have power equal to the landlord, to fully terminate their lease, if the landlord breeches any part of the rental agreement, and does not comply with corrective measures, when given the opportunity to do so. No landlord in the United States can force tenants to sign a 12 month lease. If a tenant wishes to sign a 12 month lease, the city in which the property is located must first approve such a lease, before such rental agreement can be put into force legally. The city can also delegate it's local housing agency to authorize such leases. This will insure only landlords who are serious about accommodating their tenants stay in the business. As a means to raise government revenue the city can charge an authorization fee of $35 to the landlord. *Landlords cannot intimidate, insult, threaten, refuse emergency maintenance after hours, or make snide remarks to a law abiding tenant who is a paying customer. A tenant can report this to their local housing agency as a form of discrimination. The housing agency then may choose to summon the landlord to a hearing to give an account for their mis actions. Landlords who do not heed the summons will receive the same legal consequences, as people who ignore a subpena to court. *Landlords must show proof to their local housing authority agency and the tenants, the background checks for all tenants. Landlords will pay a $350 fine for tenants to whom they have not conducted a background check. Enforced by the local police or constable. Nationwide Teacher Strike April 13, 2020Nationwide teacher strike. Shut America Down until our demands are met! It’s time to wake America up and make changes in our public school systems. What are we asking for? 1. Smaller class sizes. Use the budget more wisely. If in the past tax funds could cover 20 kids per class, with more students there should be enough money to continue. We are requesting 19 students grades k-2 and 25 3-12 grades. Student success depends on this. 2. Behavior support for students with violent or extremely disruptive behaviors. Guaranteed support from behavior interventionists, behavior rooms (immediate, not months or years of fighting for this), stronger counselor support, administrative support to help remove and reform these students to return to the classroom. Teachers and students do should not be hurt by violent behaviors. 3. Reformed professional development and staff meetings that occur during half or full day PD ONLY! No before/after school meetings. The only exceptions will be IEP meetings and after school events. Meetings should be done during work hours and should not exceed the limit set by the state forcing schools to focus on relevant PD. PD that doesn’t always focus on data, but instruction and behavior management. Data won’t go up if teachers aren’t focusing on how to teach and get students engaged. 4. No more annual curriculum changes forcing teachers to constantly change what and how they are teaching. Stick with a curriculum and trust teachers to get students where they need to be. 5. Trust. Less, stressful evaluations and observations. 2-3 observations for teachers with less than 5 years of experience. 1 scheduled observation per year for teachers with more than 5 years of experience. 6. Better Pay. Experienced educators with Masters degrees should not be make an average of 40k per year. That’s about half of what other occupations pay with experience and a masters degree. 7. No summer PD. 8. Teacher buy in. Teachers are experts in education and need to be afforded the right to vote on all central office decisions. Teachers in the classroom know what their students need and do not want money wasted on more programs that were desperately purchased to increase data results. Data will increase if teachers have the supplies they need and support they need. Teachers will be afforded the right to vote on decisions including budget. 9. Less testing. Teachers know their students capabilities without 4 different tests to prove what they already know. 10. Age appropriate curriculum. Kindergarten students need a play based curriculum and less push to be on a 2nd grade level in K. 11. More plan time. Injunction changes to prevent more deaths!Injunction hearings are conducted daily with more than 75% not substantiated according to the Judge. However, on average nearly 20 people per minute are physically abused by an intimate partner in the United States. During one year, this equates to more than 10 million women and men. 1 in 4 women and 1 in 9 men experience severe intimate partner physical violence, intimate partner contact sexual violence, and/or intimate partner stalking with impacts such as injury, fearfulness, post-traumatic stress disorder, use of victim services, contraction of sexually transmitted diseases, etc. 1 in 3 women and 1 in 4 men have experienced some form of physical violence by an intimate partner. This includes a range of behaviors (e.g. slapping, shoving, pushing) and in some cases might not be considered "domestic violence." 1 in 7 women and 1 in 25 men have been injured by an intimate partner. 1 in 10 women have been raped by an intimate partner. It is clear there is not enough protection, investigation and thorough decision making in our court system. I am a licensed counselor and owner of a well known mental health practice in Brevard County. Another patient has died at the hands of the court. Injunctions consistently denied, sheriff’s dismissing her 911 calls, and now a middle aged, perfectly healthy mom is dead due to an unexpected heart attack after a last attempt of an injunction against her ex-husband was denied by the court. Her 5 year old child is now without his mother and in the hands of the abuser and one who indirectly killed his mother. I see this time and time again. Either the mother dies by suicide because she couldn’t take being denied by the court and wouldn’t take her plea for help seriously, or she is murdered by the abuser. In this case, the amount of stress for over 2 years impacted her perfectly healthy body and suddenly stopped her heart. I want change. We need change. This has to stop. I want a law passed that will force Judges to order psychological testing and therapy for all Individuals involved in an injunction request. Children should be immediately protected and in therapy as well. The petitioner and respondent should have a psychological evaluation and a minimum of 12 sessions of therapy, report given to the judge after completion. This should be mandatory prior to any injunction being lifted or permanent. This will prevent such a lift of protection based on hear-say and simply a Judges opinion. Unfortunately, Judges do not understand manipulative tactics of an abuser which allows them to walk free and continue to physically and/or psychologically torment the victim.
