Youth Deserve Care, Not Court
Did you know that when Virginia decriminalized marijuana in 2020, we increased criminalization for youth and added harsher penalties? Current law classifies underage possession as a civil penalty, but young people can still be labeled “delinquent” for years.
Our youth deserve care, not court, for behaviors that are better addressed by families, communities, and health care professionals. By keeping young people out of the legal system for substance use, we open the door to healthier, community-based responses.
This bill outlines a pathway for youth to receive support without criminalization. Substance use should not lead to a criminal record — it should signal the need for compassion and individualized support, not punishment.
Why is this important?
Legalization for adults has not caused an increased use for children, and we must not allow misinformation to endanger our next generation. In fact, according to data reported from DJJ, there has been a significant decrease in court involvement for youth associated with marijuana. In FY 2024, there were 30% fewer marijuana intake complaints than in FY 2019. Substance use should never lead to a criminal record — it should lead to support, education, and care. Our youth decriminalization bill replaces outdated punitive practices with an evidence-based, compassionate framework that prioritizes education, family engagement, and access to community resources.
