Amend Statute Title 46. Section 46.37.530
Repeal the requirement to wear a protective helmet while operating a motorcycle, motor-driven cycle, or moped on a state highway, county road, or city street. Motorcyclist should not have to give up their freedom of choice whether or not to wear a helmet.
It is unconstitutional for Washington Sate to tell a person what they must ware on their person. The current law was enacted to receive federal highway funding which was denied to states without a mandatory seatbelt and helmet law. This was overturned by the supreme court and states that did not have mandatory seat belt and helmet laws were no longer exempt from federal highway funds. It is proven that helmets only provide minimal protection at very low speed, and the weight of the helmet may cause severe neck and spinal injury.
