Appoint Merrick Garland to the Supreme Court

President Obama should appoint Merrick Garland to a seat on the Supreme Court without Senate approval on the basis that they have not fulfilled their constitutional duty to advise and consent.

Why is this important?

Clearly the Republican majority in the Senate has withheld action on President Obama's nomination purely on political grounds, not because of any substantive objection to the nominee. The President should exert his authority to appoint on the basis that the Senate has neglected its constitutionally mandated responsibility.
