The California Family Code should be amended to require judges to specify what steps the noncustodial parent must take in order to be granted equal time with the child.
Why is this important?
How do the courts transform a stay-at-home parent into a parent who only gets to spend every other weekend with the kids? The California Family Code contains a presumption of "shared custody," but fails to define what that means. As a result, judges routinely assign one parent primary custody and limit children to spending 4 days or less per month with the other parent. If a judge feel it is in the best interest of the child to spend less time with one parent, the judge should be required to specify what steps the noncustodial parent needs to take in order to be granted equal time with the child.
