FORECLOSURE FRAUD PETITION
We, The Sovereign People of Santa Barbara County, require, simply, that our duly elected county officials - public servants who serve at our Collective Will - uphold the law in response to the known cases of foreclosure fraud existing in our county. We demand that
1. THE COUNTY BOARD OF SUPERVISORS (SALUD CARBAJAL, JANET WOLF, DOREEN FARR, JONI GRAY AND STEVE LAVAGNINO) shall place a moratorium on all foreclosure sales and evictions countywide until a full investigation has been conducted.
2. COUNTY CLERK, RECORDER, ASSESSOR AND REGISTRAR JOSEPH HOLLAND AND HIS STAFF shall henceforth cease recording foreclosure documents bearing the signatures of known “robo-signers” and shall audit 1) previously recorded documents for any “robo-signed” foreclosure documents which have been filed on title since 2001, 2) all trustee sale-related documents (from the Notice of Default through to the Trustee's Deed Upon Sale), and 3) any Assignments of Deed of Trust subject to the violations and irregularities (including MERS) that have identified by the Recorder-Assessor of San Francisco City-County (http://aequitasaudit.com/images/aequitas_sf_report.pdf). These documents shall be forwarded to the Santa Barbara District Attorney for investigation and possible prosecution.
3. COUNTY CLERK, RECORDER, ASSESSOR AND REGISTRAR JOSEPH HOLLAND shall prepare an audit of County revenues that have been lost due to fraudulent filings. This audit shall be made public and presented to the County Board of Supervisors.
4. DISTRICT ATTORNEY JOYCE DUDLEY shall immediately commence investigations into the legality of “robo-signed” documents, those possessing MERS, and those subject to the violations and irregularities that have been identified by the Recorder-Assessor of San Francisco City-County, and initiate prosecutions where appropriate.
5. SHERIFF WILLIAM F. BROWN AND DISTRICT ATTORNEY JOYCE DUDLEY shall immediately commence investigations into the legality of the actions of the individuals responsible for the auctions of foreclosed properties at the Santa Barbara Courthouse, and initiate prosecutions where appropriate. The sale of foreclosed properties shall cease pending the outcome of these investigations.
6. SHERIFF WILLIAM F. BROWN AND HIS DEPUTIES shall immediately cease any foreclosure-related evictions until the legality of these evictions is established.

Why is this important?
The Mortgage Loan Crisis, which led to the current financial crisis and recession, has lead to a Foreclosure Crisis in the County of Santa Barbara. Foreclosure sales and evictions have occurred, and are continuing to occur, that are clearly irregular and illegal. People are losing their homes without due process of law.
On March 12th, Occupy Santa Barbara, along with Occupy groups from across California, simultaneously rallied at county recorder offices across the State to call attention to the massive and ongoing foreclosure fraud. This petition was presented to 3 County officials (the Recorder, DA, and Sherriff) on the 12th and will be presented to the Board of Supervisors on April 3rd.
