International Criminal Court Complaint Against Trump, Et Al

This petition asks the International Criminal Court to investigate Trump, Sessions, Nielsen, and Azar for crimes against humanity for the abuse of migrant children and parents.

COMPLAINT TO THE INTERNATIONAL CRIMINAL COURT
I, (YOUR NAME), a citizen of the United States of America, wish to submit a complaint to the International Criminal Court (ICC) for investigation of “crimes against humanity” against the following United States of America (USA) government officials, knowing that the USA is not a state party to the Rome Statute of the ICC.
I file this complaint under the principle of “natural law” inherent in human behavior and human reasoning that governs all human conduct.

DEFENDANTS:
1. DONALD J. TRUMP, President of the United States of America.
2. JEFFERSON BEAUREGARD SESSIONS, Attorney General of the United States of America
3. KIRSTJEN NIELSEN, Secretary of Homeland Security of the United States of America
4. ALEX M. AZAAR II, Secretary of Health and Human Services of the United States of America

I accuse the above named defendants with committing “crimes against humanity” in the execution of the “Zero Tolerance Policy” (ZTP) of 2018 separating migrant children from their parents after the latter cross the U.S.-Mexico border seeking asylum from organized criminal violence in their home countries. The families come mostly from Honduras, El Salvador, and Guatemala.

I. The ZTP was adopted for the sole purpose to deter frightened mothers from bringing their children on the perilous journey to the U.S. border in search of safe harbor.

II. The inhumane acts committed by the accused are against the peace and dignity of the United Sates of America and contrary to the safety and security of victims fleeing life-threatening situations at home.

i. On or about May 2018, Jefferson Beauregard Sessions announced a “zero-tolerance” policy for illegal entry into the U.S. and directed U.S. attorneys offices in southwest states along the US-Mexico border to prosecute all cases flagged for illegal entry, “to the extent practicable.”

ii. On or about June 15, 2018, Homeland Security officials confirmed that 1,995 children were separated from 1,940 adults at the U.S.-Mexico border from April 19 through May 31. HHS officials testified that they were unable to determine what happened with many children.

iii. The Secretary of Health and Human Services has overseen the haphazard separation of children from their parents and poorly documented placement in over 100 facilities in 14 or more states around the country.

iv. In June 2018, Donald J. Trump made the following inflammatory and false assertion about the families:

1. “Criminals are using children like a "Trojan horse" to get into America and that “people coming in were bringing "death and destruction".

v. The head of the American Academy of Pediatrics called the policy "child abuse" and against "everything we stand for as pediatricians".

vi. Pediatric and child trauma experts are sounding the alarm that separating migrant children from their parents at the US border can cause serious physical and psychological damage.

Therefore,

I ask that the ICC undertake an investigation into “crimes against humanity” and that the defendants respond to answer the charges I have made.
I verify that the facts set forth in this complaint are true and correct to the best of my knowledge or information and belief.
