The US Constitution explicitly bans arresting and holding a person indefinitely without charging them with a crime. No person should be arrested and held for more than 1 to 3 days without a specific charge being levied in a court of law. The arrested person is entitled to a speedy trial.
Why is this important?
Arresting and detaining a person indefinitely for a crime they have not yet committed and may not commit is contrary to the US Constitution. The courts require a charge be made within 1 to 3 days after arrest.
