Justice For Jesse!

In May 2005 my husband Jesse Moritz was walking down the street when a Steelville Missouri police officer (Eric Schafer) approached Jesse. He stated to Jesse that he had written statements saying Jesse was selling drugs; Jesse emptied his pockets which contained 28 grams of marijuana( a misdemeanor amount), the cash from his paycheck, and postal scales. The officer then told Jesse to get in his vehicle and took Jesse to jail without reading Jesse his Miranda rights. Jesse was placed in a cell and 24 hours later a Class B felony warrant for distribution/ delivery/ possession with intent to sell a controlled substance was brought to Jesse. The money that was taken from Jesse the night he was picked up disappeared after I spoke with the Crawford County Prosecuting Attorney Sid Pearson and I informed him
that I had Jesse's paycheck stub and would take it to him. He said it would not be necessary. Jesse was appointed a Missouri Public Defender who at the time of the preliminary hearing recorded officer Schafer's under oath testimony where he admitted his case was based on the statements written against Jesse, that he had not read Jesse his Miranda rights,and the marijuana and postal scales could have been used for personal use; the money was never mentioned. Jesse's public defender highly recommended Jesse take the plea offer he was offered and plead guilty. Jesse then went along with his lawyer's recommendation and plead guilty, and placed on probation where he was later violated. When Jesse went to court (March 2007)Judge William Seay sentenced him to 12 years in Missouri Department of Corrections. In 2007 Jesse filed a motion Habeas Corpus for a sentence reduction and was denied by the Missouri Attorney General in Jefferson City Missouri due to the time frame. Jesse had no prior felonies before this case, and has now served 8 years of his 12 year sentence and is currently incarcerated in a Missouri state prison.

Why is this important?

I am starting this petition because as bizarre as this case may sound, it happened. There was no justice served in this case. Crawford County took an innocent young man and made him a criminal, they said he was a menace to society. Judge William Seay was very harsh and unjust in his decision to sentence Jesse to 12 years when child molesters and rapist are sentenced 3-7 years in prisons. Why? Where is our justice? Where is our Liberty? This man's life has been destroyed because two people made false statements and were set free of the crime they were arrested for. I am asking that this case be brought to the surface and Jesse be granted a pardon or sentence reduction and be released from prison and removed from parole (refer to MO Revised Statutes chapter 558 Imprisonment Section 558.046, August 28,2013). Jesse has served more than enough time in Missouri Department of Corrections; I want to see Justice for Jesse!!
