To: The New York State House, The New York State Senate, and Governor Andrew Cuomo
Lavern's Law
We implore our State Legislature and our Governor to do all that they can do in order to see that "Lavern's Law" (the "Date of Discovery Bill") ultimately does reach the senate floor for a vote.
Why is this important?
Lavern's Law would have begun the timeframe during which a patient is legally able to bring a medical malpractice case, on the day that the patient discovered the error, as opposed to the day that the error occurred. But Senate Majority Leader John Flanagan recently prevented the bill from reaching the senate floor for a vote.
Lavern Wilkinson died from cancer because doctors didn't inform her that a chest X-ray showed a suspicious mass. When she found out, the statue of limitations had run out, which prevented her from seeking justice.
