Why is this important?

The Seventh Amendment to the United States Constitution guarantees the right to a jury trial in all civil cases over $20. The Federal Arbitration Act, and court rulings interpreting it, have supplanted this cherished right with an expensive, secret and biased system, favoring businesses over individuals, and denying justice to thousands of victims. The Arbitration Fairness Act of 2009 addresses and corrects the abuses of arbitration, bringing fairness and balance to the civil justice system for everyone, and restoring the Constitutional right to trial by jury.


Reasons for signing

  • The right to trial by jury is a fundamental right of the people that must be preserved.
  • Arbitration is sometimes presented to the lay person as the best option, as if it's an act of civility. To do otherwise would be expensive & uncivilized.
  • The Arbitration system currently in place is nothing more than an avenue for corporate America to legally committ wrongdoing without ramifications. Arbitrators are fed by the very beast they are supposed to be holding accountable. Why would they rule against them under this set up? Most of the time, the injured party cannot afford to make a record to expose misconduct of the companies and certain Arbitrators. This must change!
