Please notify RVSD of over allocated space and return the classrooms
Dear RV Charter School Leadership:
We respectfully request that Ross Valley Charter (RVC) promptly notify Ross Valley School District that it has over allocated space for in-district students for the 2017-18 school year. Both the spirit and the terms of Proposition 39 facilities allocation requirements warrant the necessity for RVC to do so. It is imperative that RVC leadership comply with the law.
Per RVC’s Enrollment and Status Report dated May 19, RVC had in-district enrollment of 112 students. The subsequent enrollment report from June 3, 2017 shows a decline of in-district enrollment to 109 students. This departure of greater than 40% is a meaningful delta from the 189 in-district students upon which RVC based its request.
According to Title 5 of the California Code of Regulations, Section 11969.8 (b)
"A charter school must notify the school district when it anticipates that it will have over-allocated space that could be used by the school district. Upon notification by a charter school that the charter school anticipates having over-allocated space, a school district may elect to use the space for school district programs. The school district must notify the charter school whether or not it intends to use the over-allocated space within 30 days of the notification by the charter school. If the school district notifies the charter school that it intends to use all or a portion of the over-allocated space, payments for over-allocated space and pro rata share payments shall be reduced accordingly beginning at the time of the school district notification to use the space. If the school district notifies the charter school that it does not intend to use the space, the charter school must continue to make payments for over-allocated space and pro rata share payments. The school district may, at its sole discretion, reduce the amounts owed by the charter school."
RVC is scheduled to open in just over 2 months, and enrollment has been open for months. Very little enrollment movement will now happen among RVSD residents. It is time to notify RVSD that you have over allocated space. As you know, hundreds of local children are being displaced. Please follow the law, do what is right by the Fairfax and San Anselmo community, and empower the RVSD to return the sorely needed classrooms to our 6th grade children and teachers so that we, too, can plan for the upcoming year.
