Our Riparian Rights are being stripped from the citizens of Pennsylvania with the passage of H.B. 239 2007 and the citizens of this state are mad about it. The House Bill mandates that every home owner that uses private well water
disconnect and use municipal fluorinated/chlorinated water at a
high monthly price!! Townships have the option of enforcing the law and most have adopted it into their ordinances. This gives them the right to start to bill and fine you if you don’t disconnect your private well water and connect to their municipal water. The Pennsylvania Constitution reads: “The people have a right to clean air, pure water, and to the preservation of the natural scenic, historic, and esthetic values of the environment. Pennsylvania’s public natural resources are the common property of all the people, including generations yet to come. As trustees of these resources, the Commonwealth shall conserve and maintain them for the benefit of all people. Does H.B. 239 violate our consumptive Riparian Rights?? I think that is does!!
