Stagging 2nd interview working a few hours for free

I have come across two companies that indicate that with a 2nd interview
they want you to work 90 minutes to a few hours to see how hard you work for free. I was told that way they will decide who they should hire. If
you work a person for free and you pick them for a paid job does that mean that person will be a good employee????
Is this legal, they employers who do this don't care that you are paying transportation and wasting time to work for free, it's really to see if they like you. It's not base upon the most qualified person who also had the best reference. If you want to see if the person that you hire is the right one then you should give them a 1 week probation with pay.

Why is this important?

Yes I did it with one company worked for 3 and half hours doing their lunch rush, this is a kinda well know restaurant. They put me on the line I didn't get a chance to even look at the menu. I found a 2 restaurant that told me the same thing, I'm not going to waste bus fare and my time to clean their space. This job want me to start after 2pm the lunch rush is over so I guess they start cleaning. So I guess the manager think that I'm going to clean while the paid employees take it easy that day, I don't think so. I think he want to see if he like working with me.
