STOP BIG BUSINESS FROM USING THE FEDERAL COURTS TO BULLY AND STEAL INTELLECTUAL PROPERTY OF THE I...

Erica Chriswell -DBA- Eryka Kane / Ms. Kane/ Erika Kane, is an American recording artist who began her career professionally when she appeared on the now accredited platinum hit, “Get It Wet” (Atlantic Records / Creators Way Associated Labels 1997), along side Platinum recording artist “Twista”. “Twista” formed a label called Legit Ballin. Eryka then went on to record 4 additional compilation albums on Twista’s label using the stage names Ms. Kane, Erika Kane, and Eryka Kane. The Albums are titled as follows and still can be found in the marketplace: (1) Legit Ballin’ Legit Ballin’ Records 1999 (2) New Testament Street Scriptures Legit Ballin Records 2002 (3) Legit Ballaz Respect the Game AMC 2002 (4) Tha Truth released in Koch 2006. Eryka went on to start her own boutique label in 2009 and engineered and recorded her own music in her own “Cat House Studio’s” and inked her own digital distribution deal. She promoted and distributed The Addiction and Diesel in 2010 and Raw University released in 2011. Both Diesel and Raw University were distributed by way of iTunes and other major online retailers.

In 2009, Eryka started the process to trademark her name she had been using since 1999. She began the process and was informed by the U.S.T.P.O. that there were no conflicting marks. Months later, strangely she received notice that another party by the name of Big Score Entertainment was also seeking to Trademark a name phonetically identical to Eryka’s but bearing a different spelling (Arika Kane). Big Score alleged use of the name— since 2008.

BSE initiated a clearly unmeritorious battle against Eryka as seen by the many albums which prove she used the Name(s) Ms. Kane, Eryka Kane, and Erika Kane as early as 1999, 10 years before BSE’s imposter of an artist decided to state claim to the name. BSE has now hired a Chicago firm, Muriel Law Offices, to assist them in the action that is before the Illinois Federal Court. The only argument BSE’s lawyers can seem to drum up is accusing Eryka of using a ghostwriter to write her pleadings to the court.

Big Score Entertainment and their attorneys are intentionally dragging out the court proceeding while they continue to aggressively market and promote their artist "Arika Kane". They are running major ads on VH1 and using other marketing mediums to attempt to promote a name phonetically identical to that of "Eryka Kane".

Sign this petition and tell Judge Edmond Chang of the US District Court of Illinois that in case 1:11-cv-00861 Erica Chriswell is a public figure that has operated under the name(s) Erika Kane/Eryka Kane since as early as 1999 and we have listened to and purhased her music in the marketplace. We want the Honorable Judge to Immediately (1)Freeze All of Big Score Entertainments Assets (2) Provide Erica Chriswell -dba- Eryka Kane with a fair, speedy trial and (3) place heavy sanctions upon Big Score Entertainment due to their malicious intent to steal a mark and in doing such by abusing the court system. Big Score Entertainment and the world has heard Erica Chriswell's dba Eryka Kane's works and we will not let history be rewritten she is the rightful owner of the Eryka Kane, Erica Kane, Erika Kane mark(s) and also the owner of any mark sounding phonetically identical to her mark(s). Stop big companies from stealing from small independent artists now!!!!!!

Why is this important?

Stop Big Connecticut Company from stealing Chicago native Erica Chriswell -dba- Eryka Kane's Trademark. Erica is a Chicago native born and raised in the Wild Wild Hunnits. Erica managed to get her break and chance to make it out of the hood when she performed on "Get it Wet" with Twista. I'm sure you all have heard many of her works. She is an accredited Platinum independent artist. Support her in her fight to stop a big company from trying to use big marketing campaigns and the court system to steal her "Eryka Kane" Trademark. She belongs to Chicago and she is a independent artist as many of you are. Don't let a big company get away with stealing the trademark of an independent struggling artist who has invested in her career for over 10 years. Chicago and the rest of the world should support this cause!
