Current analogue drug laws allow substances to be treated as illegal based on vague claims of “substantial similarity” to prohibited drugs.
 Courts, scientists, and even federal agencies regularly disagree on what this means. As a result, people cannot reasonably know what is legal until after prosecution. This is unconstitutional conviction and not only violates rights but has put barriers in the way of a massive mental health renaissance with the use of substances proven safe and effective.
 
We need to stop standing for the violation of basic principles of due process, this enables arbitrary enforcement, and disproportionately harms researchers, small businesses, and individuals struggling with complex mental health issues including but not limited to severe PTSD, substance abuse disorder & treatment resistant depression. These laws have failed to stop dangerous drugs, while simultaneously threatening safe psychedelic research and innovation. 

Why is this important?

We call on lawmakers to reform analogue laws by: 

  • Ending vague, case-by-case criminalization
  • Protecting non-harmful, non-addictive psychedelic analogues
  • Replacing uncertainty with clear, science-based regulation
 
Drug policy should be based on evidence, clarity, and public health — not guesswork and fear. We are not asking for unrestricted allowance to substance but clear regulations and standards that allow researcher’s, businesses and mental health specialists to work together and encourage innovation and safety.
Illinois has not only encouraged innovations in this field but has taken pride in its commitment to evidence based policy and criminal justice reform, we have an opportunity to continue to set the standard and lead the way in this ever changing world with rapidly growing issues that are demanding the immediate attention of innovative regulation.
