Pueblo County residents unite to call on Pueblo County Coroner Brian Cotter to end the compounding pain and suffering inflicted on local families by resigning immediately. He has betrayed the public trust and must be held accountable—or face removal through a costly and time-consuming recall process.

This is an unthinkable betrayal: grieving families now fear their loved ones were mishandled—or worse—while Brian Cotter, the County Coroner, may have even provided fake cremains. Public trust is shattered. If he refuses to resign, he will force taxpayers and those already suffering to endure the burden of a drawn-out recall.

We, the residents of Pueblo County, sign this petition as a vote of no confidence in County Coroner Brian Cotter.

Whereas, Brian Cotter, in his capacity as Pueblo County Coroner, has demonstrated gross negligence and a failure to uphold the public trust by allowing decomposing bodies to accumulate over many years at a funeral home he operates;

Whereas, credible reports indicate that some of these bodies had been stored for over 15 years, and that families may have been misled into receiving fake cremains in place of their loved ones;

Whereas, this conduct represents a grave breach of professional, ethical, and legal responsibilities, causing significant emotional harm to the families of the deceased and irreparable damage to the integrity of the Coroner’s Office;

Whereas, Brian Cotter has served simultaneously as the Pueblo County Coroner and the co-owner/operator of a private funeral home, creating an inherent conflict of interest that undermines the impartiality required of a public official responsible for death investigations and the handling of human remains;

Whereas, this dual role raises serious ethical concerns, including the potential for self-dealing, preferential referrals, and financial gain derived from public office, in direct violation of the ethical standards expected of elected officials and medical death investigators;

Be it resolved, that this conflict of interest constitutes a fundamental breach of public trust, undermines the credibility of the Coroner’s Office, and further justifies the demand for Brian Cotter’s immediate resignation or removal from office;

Be it further resolved, that we, the undersigned, express our vote of no confidence in Brian Cotter and demand his immediate resignation from the office of Pueblo County Coroner. Should he fail to resign, we will support and pursue all legal and democratic means necessary to initiate a formal recall.

Why is this important?

The Pueblo County Coroner is an elected official. Only the residents of Pueblo County and the City of Pueblo have the power to remove elected officials from office. No other public officials have the authority to “fire” the Coroner. It is our responsibility, as citizens and residents, to take action and restore justice.

This digital petition is NOT a recall and will not force him out of office, but it seeks to avoid the need for one—a costly, painful, and prolonged process that would only compound the grief, mourning, and devastation already experienced by those affected. We believe that if we reach 17,000 signatures, the Coroner will recognize the public’s will and step down voluntarily, as is his ethical obligation under these circumstances.

Colorado’s Governor, the Pueblo County Sheriff, County Commissioner Miles Lucero, and State Representative Tisha Mauro have all called for Brian Cotter to resign, following the discovery of multiple decomposing human beings improperly stored—possibly for up to 15 years—at the funeral home he operates.

We—the residents of Pueblo County and the City of Pueblo—stand in unified solidarity with the countless victims of Davis Mortuary and join in the call for Brian Cotter to resign immediately. If he refuses, we are prepared to initiate a formal recall. But let it be clear: recalls are expensive and should not be necessary in a situation as clearly unethical—and potentially criminal—as this (charges pending investigation).

End the pain. Stop compounding the trauma for families already suffering.

Resign now, Mr. Cotter—no more families should be hurt.

As of Friday, 8/29 Brian Cotter resigned his position as coroner through his attorneys by announcing his "Retirement" effective Sept. 2 so he can collect another payroll. This is upsetting to everyone involved because of the unknowns.

Please share this petition on your social media and through email with anyone is wanting to sign the real paper recall petition as well. As soon as I have confirmed where they will be available to sign them I will send out a regular email indicating convenient signing locations to everyone who signed her online also. Hopefully we don't have to go through the formal process, but if we do then we can use this platform to inform and organize those who are united in supporting all the families who have been retraumatized by this news. -Andee
