We, the undersigned residents of Santa Fe and homeowners of Sol y Lomas, Arroyo Chamiso, SENA and surrounding neighborhoods oppose the rezoning of 2200 Old Pecos Trail
RELEVANT INFORMATION
PROPOSAL FOR REZONING OF 2200 OLD PECOS TRAIL
The zoning change request does not meet the City of Santa Fe’s criteria for approval of such a request, which are set forth in City Code Section 14-3.5(C). If the City does not follow its own rules for rezoning, no parcel in Santa Fe that adjoins undeveloped property is safe from development that is not in keeping with neighborhood.
The zoning change request and proposed subdivision are contrary to the neighborhood preservation language in the Revised Home Rule Charter - Section 2.04. The neighborhood most relevant to the proposed subdivision is Sol-y-Lomas, which is characterized by one-house per acre, tucked among abundant native vegetation, with no sidewalks or streetlights to detract from the country-like setting.
The least-dense subdivision proposal for 22 houses on 9.59 acres, described as “Alternative 3” at the December 9 ENN, would not appear to comply with the city code requirement for 50% of each lot to be “open space,” which is set forth in City Code Section 14-5.5(A)(4)(b)(v).
Old Pecos Trail (OPT) is the last remaining scenic corridor into Santa Fe and its value to our community is clear from the designation of the entrance to OPT at Interstate 25 as Santa Fe County Open Space and from a 20-year, community-wide effort to ensure that this value is protected by appropriate ordinances and zoning.
We requested a second ENN meeting to address material changes that had been made to the Development Proposal Plan and inaccurate information on the initial application by the developer. The developer's response was to increase density instead.

Why is this important?

URGENT: We have a short window to protect Santa Fe’s Old Pecos Trail Scenic Corridor from over development. The proposed re-zoning of this nearly 10 acre property at 2200 Old Pecos Trail would set a dangerous precedent for the last remaining Scenic Corridor to Santa Fe’s Historic District.

The Planning Commission Hearing date is set for 6/2/2022. There is also a hearing on May 27, 2022, whose outcome will significantly impact the outcome of the Old Pecos Trail rezoning attempt. Please review both and attend the meetings. There is a link below to information needed.

So far as we know, the City still has not placed this application on the Planning Commission's hearing agenda for May or June. Please encourage neighbors and businesses throughout Santa Fe to sign this petition.

To receive details re: the 3/8 ENN , please let me know. Dan Esquibel confirmed that he doesn't have time to read nor respond to our letters. The comments will be included in the packet which goes to the Planning Commission, but members will most likely also not have time to read and consider the issues. For this reason, it will be up to local residents to develop and present to the PC and Governing Body "facts" regarding the adverse impacts of the requested rezoning & proposed subdivision for members to consider & address. The Early Neighborhood Notification (ENN) on 2/10/22 demonstrated the strong opposition to this proposal. However, many people were unable to access it because it was capped at 100. Therefore, Dan Esquivel, Planning Senior, City of Santa Fe Planning Department said another ENN will be required. No date has been announced yet. The application could still go to the Planning Commission in April.
Mr. Esquibel asked people to write him to ask for the full ENN to be presented again, otherwise it would be just a period for questions and comments. Please write him at:

UPDATE 1/30/22
The developer has submitted a new denser plan with the city than plan 3, which we were presented at the first ENN. Rather than basing their application on factual and legal criteria for rezoning in City Code 14-3.5 (C), they point to "future land use designation" of 3-7 dwelling units per acre. If this proposal is accepted, it will set a precedent that will allow further development on the last scenic corridor to historic Santa Fe. Please write personal letters in addition to signing this petition and please forward the petition link to those who would support maintaining the character of Santa Fe, which draws tourist dollars to our city and makes our City Different a place we want to remain.

UPDATE!
It appears that the proposal to re-zone will not be on the February 3, 2022 agenda for the Planning Commission Meeting. We learned that that the application for the proposal was not submitted to the planning department on time. Therefore, a 2nd ENN will be required. This is good news! The next deadline for application is February 21, 2022, for the proposal to be put on the April 7, 2022 Planning Commission agenda. A new Early Neighborhood Notification (ENN) would have to occur prior to February 10, 2022. Please ask friends and neighbors to join us by signing the petition to protect Santa Fe’s Old Pecos Trail Scenic Corridor. Thank you.
