PETITION FOR MANDATORY CLASSROOM VIDEO MONITORING FOR SPECIAL NEEDS STUDENTS
TO: The State Legislature and the Department of Education
STATEMENT OF PURPOSE & CORE MANDATE
We, the undersigned citizens, submit this petition to advocate for our most vulnerable student population.
To ensure absolute accountability, physical safety, and the highest standard of specialized care, we petition for the immediate passage of legislation mandating continuous video surveillance and proactive state evaluation within all classrooms, specialized therapy areas, and daycare environments serving special needs children.
KEY ACCOUNTABILITY REQUIREMENTS
• Mandatory Surveillance Implementation: Install high-definition, continuous video and audio recording systems in all classrooms, private instruction areas, therapy rooms, and auxiliary care spaces serving children with documented special education or developmental needs.
• Independent Oversight & Evaluation: Mandate that recorded footage is not merely archived passively, but actively monitored and audited by certified, independent third-party oversight bodies or designated state educational officials.
• Monthly State Reporting: Require comprehensive evaluation reports to be compiled and submitted to the State Department of Education on a monthly basis to track protocol compliance, evaluate classroom environments, and proactively flag behavioral anomalies or structural issues.
STRICT PRIVACY PROTECTIONS & CONFIDENTIALITY PROTOCOLS
• Restricted Access Control: Explicitly prohibit general or unauthorized viewing of recorded materials. Access to secure footage shall be restricted exclusively to authorized state evaluators, executive school administrators, law enforcement personnel, or legal parents/guardians during the formal investigation of an explicitly filed incident report.
• Absolute Ban on Public Broadcasting: Prohibit any live-streaming, digital transmission over unencrypted networks, or sharing of classroom footage on public platforms or unauthorized devices.
• Redaction and Peer Privacy: Require modern digital redaction (such as facial blurring or obscuring) of any peers or students not involved in a reported event prior to releasing footage for external administrative or legal reviews, fully preserving federal and state student privacy rights (such as FERPA).
RIGOROUS FOOTAGE RETENTION GUIDELINES
• Standard Minimum Retention: Securely archive all recorded video and audio data for a mandatory minimum period of ninety (90) calendar days from the date of recording
• Immediate Incident Holds: Place an indefinite administrative and legal hold on any footage flagged by a parent, educator, or state evaluator for a pending investigation. Flagged footage must be preserved without alteration until the investigation and any subsequent legal proceedings are fully and permanently resolved.
• Verified Secure Destruction: Mandate that upon the expiration of the lawful retention window, all data must be completely overwritten or permanently destroyed using certified, high-security digital purging standards to eliminate the risk of subsequent data breaches.

Why is this important?
Children with special needs—specifically those who are autistic, nonverbal, or have significant developmental and physical delays—face a disproportionately high risk of mistreatment, neglect, or abuse. Because many of these children lack the verbal capacity or communication skills to advocate for themselves, report incidents, or articulate their daily experiences to parents and guardians, traditional reporting mechanisms are entirely insufficient.
