Constitutional Amendment on GunsIt is apparent that a majority of the elected members of the United States Congress do not have the political courage or political will to enact meaningful legislation to deal with the epidemic of gun violence facing our nation. Accordingly, under Article V of the United States Constitution, we the citizens of the United States demand that the Legislatures of two-thirds of our States apply to the Congress to call a Constitutional Convention to adopt the Amendment to the United States Constitution set forth below. The Second Amendment to the United States Constitution is amended by adding the following at the end thereof: 1. For purposes of this Amendment, “arms” are defined as weapons that are activated by a trigger mechanism. 2. An arm that has a trigger mechanism that is continually activated without releasing and re-pulling the trigger and/or an arm that will shoot more than ten (10) times sequentially without re-loading ammunition may be owned and/or used only by Federal and State militia; Federal, State and Local Government Law Enforcement agencies; and the original manufacturer of the arm prior to its original sale. All such arms that are owned by individuals or other entities must be delivered to a representative of the Federal Government within ninety (90) days of the enactment of this Amendment. Thereafter, any such arms shall be confiscated by representatives of the Federal Government and the owner of such arm prosecuted for a felony punishable by a fine of Ten Thousand Dollars ($10,000) and imprisonment for two (2) years. It is illegal to sell such arms to anyone that is not allowed to own such arms, and any violation shall be prosecuted for a felony punishable by a fine of One Hundred Thousand Dollars ($100,000) and imprisonment for ten (10) years. It is illegal for any person or entity prohibited from owning such an arm to convert the arm’s trigger mechanism to continually activate without releasing and re-pulling the trigger and/or enabling the arm to shoot more than ten (10) times sequentially without re-loading ammunition, and any violation shall be prosecuted for a felony punishable by a fine of Ten Thousand Dollars ($10,000) and imprisonment for five (5) years for each such arm so converted. 3. All arms with the boundary of the United States of America shall be registered with an agency of the Federal Government within ninety (90) days of the adoption of this Amendment. That agency shall maintain a data base of all such arms with a registration number assigned to that arm. The data base shall include the arm’s serial number placed on it by the manufacturer, the owner’s name, address and social security number or any successor number used for identifying persons. The owner of the arm shall provide current registration information as any of it changes, and the owners shall maintain possession of the registration for that arm. Any violation of this provision shall be prosecuted as a felony punishable by a fine of Ten Thousand Dollars ($10,000) and imprisonment or five (5) years for each arm not so registered. 4. The agency of the Federal Government that maintains the registration information as described in 3 above shall also maintain a data base of all persons who are not allowed to own arms. Arms may not be owned or made available for use by any of the following persons: a. Those persons convicted of a felony by a Federal or State Court; b. Those persons listed by any agency of the Federal Government as belonging to a group whose goal is to attack persons or property within the United states of America and/or individuals not allowed to fly on aircraft by an agency of the Federal Government; and c. Those persons who suffer mental impairment that places society at risk of an attack by that person. Mental impairment shall be determined by two (2) mental health physicians, and they shall provide the names of such persons to the Federal agency maintaining gun registration. Any violation of this provision by a person prohibited from owning an arm or by a person who sells or gives such a person an arm shall be prosecuted as a felony punishable by a fine of Ten Thousand Dollars ($10,000) and imprisonment for five (5) years for each violation. 5. Prior to the sale of an arm to any person in the United States of America, the name, address and social security number or any successor number used for identifying persons must be sent to the Federal Agency that maintains the list of persons not allowed to own an arm. Only after the Federal Agency notifies the seller that the person is not prohibited form owning an arm may the arm be sold to that person. That person must register the arm with the Federal Agency maintaining the arm registration at the timer of the purchase of the arm. Any violation shall be prosecuted as a felony punishable by a fine of Ten Thousand Dollars ($10,000) and imprisonment for five (5) years for each sale in violation of this provision. 6.
