Demanding Justice For Robert "Bobby" Barrios for Fatal Hit-and-Run on his 35th Birthday

We are requesting your support and participation in our endeavor to reform California's hit-and-run legislation, aiming to eradicate the motivation to flee from the scene. Our proposition entails holding accountable any drivers who neglect to remain present, offer assistance, or promptly seek aid following a collision resulting in death or severe injury. These individuals should face charges and penalties equivalent to those imposed on individuals found guilty of driving under the influence during a fatal accident. Engaging in actions that deliberately postpone arrest or waiting until sobriety is attained before surrendering oneself after a crash must be met with grave repercussions.
Background: On New Years eve 2024, Robert "Bobby" Barrios Jr. was out celebrating his 35th Birthday with his cousins at Bay 101 Casino located in San Jose, CA where upon shortly leaving the casino after winning- he was intentionally hit by a car and left for dead by his Ex Wife's daughters girlfriend over an argument about a makeup bag. Before paramedics and CHP were on the scene, the perpetrators had already left.
The Justice for Bobby is a petition reform about the Justice other people involved in deadly hit-and-runs, this issue has been a neglective element that needs, no demands immediate attention. Pursuing perpetrators in hit-and-run crime is not just a moral imperative, but a fundamental necessity for a just society. The call for reform is not negotiable. Hit and run incidents inflict irreparable damage and cannot be tolerated. It is time to hold individuals accountable and ensure that justice is served. The pursuit of this cause is non-negotiable; it's a demand for accountability and justice.
Codes of conduct are an important tool for police officers to guide them in their daily decision making efforts to pursue justice for all.
What needs to happen? What Do We Need to Change?
California's felony hit-and-run laws are too lenient. They do not match the severity of the crime and may in fact provide an incentive for drivers to flee the scene of a deadly crash. Under California's current law, a driver who kills or seriously injures someone and stays at the scene of a crash will face enhanced charges and penalties if they are determined to be under the influence of alcohol or drugs (DUI). In comparison, a driver who runs away to avoid or delay DUI testing will likely avoid these enhancements. Even if a driver is apprehended or surrenders shortly after a hit-and-run it may be difficult, if not impossible, to determine whether or not they were DUI at the time of the crash. According to Mother's Against Drunk Drivers' website "...hit-and-run crashes are punished less severely than alcohol-related crashes, we have given drunk drivers an incentive to flee the crime to try to escape having a blood alcohol content test done." Why should a driver be rewarded for hitting a person and running away? It is always the right thing to stay!

Why is this important?
This is important because the frequency of hit-and-run incidents resulting in tragic fatalities especially in California is on the rise and escalating at an alarming rate. It has become an all-too-common occurrence to witness drivers fleeing the scene without even making sure the victim is ok or even a simple call for assistance. We can no longer turn a blind eye to this distressing trend. Prayer is a great help and proves to be sufficient for the grieving families and friends left behind- but the perpetrators need to get their fair end of the deal also and should be punished to the full extent of the law for their carelessness act in taking a life of an innocent person in such a shameful way and without remorse!This is a crime that cannot be prevented, but we can make less occuracnes if we try. It's time for us to take action now. This is important not only just for Bobby but for everyone who has been affected by hit-and-run incidents without the perpetrators being prosecuted

I plan to deliver this petition in person by hand with family members of Bobby Barrios as soon as I get the number of signatures that I need.
