We Object to the Loss of Medicaid Rights, and Demand Redress!

WHEREAS numerous members of Congress and Donald Trump, acting under color of authority, willfully violated the rights and are recklessly endangering approximately 11.8 million people, who will now lose health insurance due to the roughly $1.1 trillion tax cut (Constantino, Annika Kim July 1 2025),
WHEREAS Medicare and Medicaid Act secures the right to access necessary healthcare services for eligible individuals, including low-income families, children, pregnant women, seniors, and people with disabilities,
WHEREAS it also provides financial protection from medical debt and can offer access to long-term care services,
WHEREAS the Act secures certain rights for individuals in long-term care settings, such as autonomy, privacy, and the right to furnish their living spaces,
WHEREAS States are required to provide the following mandatory benefits:
- Transportation to medical care(1902(a)(4), 42 CFR 431.53 and 42 CFR 440.170)
- Inpatient hospital services (1905(a)(1), 42 CFR 440.10)
- Outpatient hospital services (1905(a)(2)(A), CFR 440.20(a))
- Rural health clinic services (1905(a)(2)(B), 42 CFR 440.20(b))
- Federally qualified health center services (1905(a)(2)(C))
- Laboratory and X-ray services (1905(a)(3), 42 CFR 440.30, and 42 CFR 441.17)
- Nursing facility services (1905(a)(4)(A), 42 CFR 440.40 and 42 CFR 440.155)
- Early and Periodic Screening, Diagnostic, and Treatment (EPSDT) services (1905(a)(4)(B), 1905(r), 42 CFR 440.40, 42 CFR 441 Subpart B)
- Family planning services (1905(a)(4)(C), 42 CFR 441.20)
- Tobacco cessation counseling for pregnant women (1905(a)(4)(D))
- Physician services (1905(a)(5), 42 CFR 440.50)
- Home health services (1905(a)(7), 42 CFR 440.70 and 42 CFR 441.15)
- Nurse Midwife services (1905(a)(17), 42 CFR 440.165 and 42 CFR 441.21)
- Certified pediatric and family nurse practitioner services (1905(a)(21), 42 CFR 440.166(b) and 42 CFR 441.22)
- Freestanding birth center services when licensed or otherwise recognized by the state (1905(a)(28))
- Medication Assisted Treatment (MAT)(1905(a)(29))
- Routine patient costs of items and services for beneficiaries enrolled in qualifying clinical trials (1905(a)(30))
WHEREAS Medicaid provides important consumer protections and due process rights, many of which are enforceable through legal action (National Health Law Program),
WHEREAS aforementioned rights are guaranteed under the Ninth Amendment of the Constitution of the United States; we hereby reserve any and all such rights and, under protest, object to the loss, violation, abrogation, etc. of any and all of them,
WHEREAS we, the undersigned, are due monetary damages caused by the legal injury to our rights, and due to the fear, anxiety, emotional pain and suffering, and severe undue stress caused by the threat of the loss of such rights,
WHEREAS the federal government violated our trust in them due to the fact that Congress and the President have violated our rights and now recklessly endanger our lives,
WHEREAS Single-Payer Healthcare is the most cost-effective form of government-run healthcare,
WHEREAS we cannot depend on the federal government to uphold such rights,
THEREFORE we, the undersigned, do hereby petition the Government for redress due to injuries and harm sustained, and demand the following:
WHEREAS we, the undersigned, are due monetary damages caused by the legal injury to our rights, and due to the fear, anxiety, emotional pain and suffering, and severe undue stress caused by the threat of the loss of such rights,
WHEREAS the federal government violated our trust in them due to the fact that Congress and the President have violated our rights and now recklessly endanger our lives,
WHEREAS Single-Payer Healthcare is the most cost-effective form of government-run healthcare,
WHEREAS we cannot depend on the federal government to uphold such rights,
THEREFORE we, the undersigned, do hereby petition the Government for redress due to injuries and harm sustained, and demand the following:
- Representation by member(s) of the American BAR Association to advocate for us and ensure restitution and continued care for any and all damaged parties,
- Continued medical coverage indefinitely until our own Single-Payer system may be set up and run by the State of Iowa,
- Monetary damages/restitution to be deposited into our personal accounts, and for use in establishing a new publicly-owned Credit Union owned by the State of Iowa,
- Public acknowledgment by public officials that our Ninth Amendment right has in fact been violated due to the aforementioned rights secured by the Medicaid and Medicare Act having been violated,
- Monetary damages for any and all United States Citizens whose rights have been violated, and who are now suffering as we are, so that continued coverage may established nationwide until single-payer systems may be set up throughout the United States to ensure domestic tranquility and to promote the General Welfare, in accordance with the Preamble of the US Constitution

Peoples' lives are in danger due to the recent cutting off of medically-necessary services, and we must establish the most cost-effective form of healthcare for all which is owned by We the People to ensure we are never put in harm's way like this again.
