According to the federal complaint, the Phoenix VA Police and associated leadership:
- Violated Ramirez's Fifth Amendment Right to Remain Silent by coercing him to participate in an administrative interview with criminal implications, under threat of disciplinary action.
- Ignored Garrity Protections — Ramirez was never advised of his right to remain silent or protected from the use of compelled statements in a criminal case. Instead, he was intimidated into speaking while under duress.
- Bypassed Kalkines Procedures — Federal investigators failed to grant Ramirez immunity before compelling him to answer administrative questions, placing him at direct legal risk.
- Denied Weingarten Rights — He was not allowed union or legal representation, despite formally requesting both.
- Issued a federal criminal citation for possession of a firearm on VA property — despite being a sworn officer — in a retaliatory move designed to strip him of his job and credibility. That charge was later dismissed by the U.S. Attorney’s Office.
- Targeted him based on race, color, and prior EEO activity, as documented in an extensive affidavit detailing a toxic, discriminatory, and retaliatory culture within the Phoenix VA Police Department.
These events followed a pattern of whistleblower retaliation. Ramirez had previously reported firearms mishandling, discriminatory treatment of minorities, and misconduct by command staff — including violations of VA policy that went ignored or covered up.
