The 1%: Black Officer Punished by the Phoenix Veterans Affairs Police After EEO Victory

 
In March 2022, Khori Francis successfully resolved his Equal Employment Opportunity (EEO) complaint against Phoenix Veteran  Affairs Police (VA Police) through mediation. However, instead of receiving fair treatment, Francis, a Black federal police officer, became the target of retaliation and harassment by department leadership.

🚨 RETALIATION & ESCALATION

After winning his EEO complaint, Francis received a delayed national-grade promotion. Shortly afterward, management maliciously labeled his actions as “lazy” and “careless,” claims that perpetuated harmful racial stereotypes rather than factual performance issues.

In early 2023, Francis's police authority was abruptly suspended without due process, and he was unjustly referred for possible federal criminal charges—a step rarely taken and inconsistent with departmental practices. Soon after, he received a formal letter from the U.S. Attorney’s Office indicating intent to pursue charges for alleged "timecard fraud," a tactic often used by law enforcement agencies to remove unwanted personnel.

Francis met with federal prosecutors, who acknowledged the case was not a priority. No charges were filed, and Francis was forced to resign under immense pressure. He quietly rebuilt his life, believing the matter had concluded.

⚠️ A TROUBLING PATTERN

Francis’s federal referral starkly deviated from the Phoenix VA Police Department’s established practice of handling 99% of criminal cases at the local state level. Another minority officer, Mario Ramirez, similarly faced federal referral after filing an EEO and substantiated whistleblower complaint (Ramirez Allegations). This highlights a troubling pattern of selective federal prosecution targeting minority officers who assert their rights.

⚠️ CONFIRMED MISCONDUCT & DISCRIMINATION

In 2023, official VA investigations confirmed racial harassment against another Black officer, resulting in a settlement in 2024 (Discrimination Lawsuit). Further investigations revealed multiple VA officials provided false or misleading statements under oath, severely undermining departmental integrity.

⚠️ 2024–2025: RENEWED TARGETING AFTER CHIEF'S DEPARTURE

After peacefully rebuilding his life throughout 2024, Francis learned in January 2025—mere months after a Chief of Police with whom he'd clashed departed the department—that federal prosecutors revisited his case. This timing raised alarming concerns of renewed retaliation linked to the former chief’s exit.

The Phoenix VA Police's retaliatory actions against Francis are not isolated incidents but part of a broader history of misconduct, corruption, and selective targeting (VA Misconduct Report). In early 2023, Francis experienced severe escalation: his police authority was abruptly suspended without due process, and he was referred for potential federal criminal charges—an extreme measure rarely taken. Soon after, he received formal notice from the U.S. Attorney’s Office regarding possible charges related to alleged timecard fraud. When Francis met with federal prosecutors, he was informed that the matter was not a priority, and no further action was pursued. Francis resigned under pressure in January 2023, subsequently rebuilding his life as a respected business owner and private citizen.

It is crucial to highlight that the Phoenix VA Police Department historically directed nearly all criminal cases—approximately 99%—to Maricopa County state court, explicitly avoiding federal prosecution except for minor petty offenses. Francis became the rare exception—the "1%"—facing federal charges, suggesting selective targeting and retaliation following his successful EEO complaint.

This is not an isolated incident. Another minority officer, Mario Ramirez, experienced similar retaliatory federal action. Ramirez, who filed an EEO complaint and a substantiated whistleblower disclosure, faced disproportionate federal charges involving a petty offense citation in 2023. Further confirming systemic issues, an official investigation in 2023 by the VA’s Office of Resolution Management, Diversity & Inclusion (ORMDI), and a Final Agency Decision (FAD) issued by the Office of Employment Discrimination Complaint Adjudication (OEDCA), found the department liable for racial harassment against another Black officer. This officer had an impeccable service record, highlighting the severity of the department’s discriminatory practices. This case was settled out of court in 2024. In 2024, Francis successfully moved forward with his life, operating his business without issue. A key official involved in previous conflicts left the department, initially causing Francis no concern. However, in January 2025—just months after this official’s departure—the U.S. Attorney’s Office suddenly reignited Francis’s previously dismissed case. This suspicious timing raises questions about retaliatory motives linked to previous department leadership.

Adding to the severity, multiple Phoenix VA Police officials potentially became Giglio impaired in 2023 by providing false statements or omitting crucial information during ORMDI investigations. Such actions violate several federal statutes and guidelines, including:

  • 38 C.F.R. § 0.735-12: Requires honest testimony in disciplinary and employment investigations.

  • VA Handbook/Directive 5025: Mandates truthful cooperation in official investigations.

  • 18 U.S.C. § 1001: Criminalizes false or fraudulent statements in federal matters.

  • 5 U.S.C. § 2302(b)(9): Prohibits retaliation against federal employees exercising protected rights.

This petition aims to hold the Phoenix VA Police Department accountable for its actions and systemic issues. Relevant historical misconduct further demonstrates a troubling pattern:

There appears to be a significant effort by the U.S. Attorney’s Office, which is currently representing the Department of Veterans Affairs in matters arising from the actions of the Phoenix VA Police, to prevent this case from advancing to discovery. This raises important and reasonable questions about what information could come to light if discovery were to proceed.

Could "discovery" reveal longstanding concerns involving the Phoenix VA Police, including patterns of discrimination, reports submitted to OSOLE and OSP, or the volume of EEO cases that contributed to Giglio implications and a potentially imperiled department?

These questions warrant transparency and careful examination. In the meantime, continued support for Frances and his pursuit of accountability remains essential.

The U.S. Attorney’s Office for the District of Arizona is still doing everything it can to prevent the Francis case from reaching full disclosure. And the question must be asked: what exactly are they trying to keep from the public?

Everyone already knows what has been happening inside the Phoenix VA Police Department:

• Ongoing discrimination
• Retaliation against whistleblowers
• Prohibited Personnel Practices (PPP violations)
• Leadership misconduct ignored for years

These issues are so blatant that the Secretary of Veterans Affairs recently issued a new, aggressive EEO and anti-retaliation policy — a policy that directly mirrors the same patterns and abuses that Phoenix VA employees and the Concerned Citizens have been reporting recently.
