Ban Insurrectionists from Any Ballot in Ohio

Empathy is the soul of our republic and its democratic institutions, where citizens care for each other, leading to freedom and fairness for all. I am a pro-empathy freedom voter. Thank you for your public service and your oath to the US Constitution.

I am requesting a formal review about whether former President and criminal defendant Donald Trump, who conspired in the insurrection that led to the January 6th Capitol attack to prevent the certification of Joe Biden’s election, and Ohio Congressmen Warren Davidson, Bill Johnson, and Jim Jordan, who under false pretenses voted in support of criminal defendent Trump’s false claims, are barred from the ballot in the State of Ohio through Section 3 of the 14th Amendment, because they don't care to protect the US Constitution.

Section 3 of the 14th Amendment disqualifies from the ballot any person who “shall have engaged” in an “insurrection,” or “given aid and comfort” to insurrectionists. For such a disqualification, criminal defendant Trump, and Ohio Congressmen Davidson, Johnson, and Jordan are not required to be first convicted of any crime - as the Congressional Research Service notes - https://bit.ly/ohinsurrection.

As the US Constitution mandates, no one who has engaged in an insurrection or who has given aid and comfort to an insurrectionist should be permitted to be on the ballot. The time to review if criminal defendant Trump, and Ohio Congressmen Davidson, Johnson, and Jordan have done just that and are barred from the ballot is now—well before the 2024 election.

Last year, after a trial in New Mexico, a judge ruled that January 6 was an “insurrection” within the meaning of the 14th Amendment and that Otero County Commissioner Cuoy Griffin was removed from office and disqualified from the ballot for “engaging” in that attack. Criminal defendent Trump’s actions, as detailed in the final report of the “Select Committee to Investigate the January 6th Attack,” and Ohio Congressmen Davidson, Johnson, and Jordan far exceed the actions of Griffin in terms of “engaging” in the Jan 6 insurrection. While the New Mexico ruling is not binding in this state, it is persuasive in its reasoning to protect a caring society, and I urge your offices to read it. https://bit.ly/nmCARES

Finally, conservative legal scholars have recently penned articles concluding that given the uncaring and irresponsible conduct of criminal defendent Trump and Congressmen Davidson, Johnson, and Jordan, the US Constitution does, in fact, bar them from the ballot. As the US Constitution mandates, no one who has engaged in an insurrection should be permitted to be on the ballot because they don’t care to protect the US Constitution and its rule of law. The time to review if Trump has done just that and is barred from the ballot is now—well before the 2024 election.

Thank you for considering this issue that is vitally important to protecting America’s strong, diverse, nurturing families committed to protecting and empowering each other through the US Constitution.

Why is this important?

Empathy is the soul of democracy, people caring for each other, leading to freedom and fairness for all. My father and father-in-law joined other caring people in the United Nations against fascism during World War II and won. Although our parents and grandparents hoped that pro-empathy freedom would prevail in the future and fascism would be done forever, they also planned for the worst.

President Harry Truman, a Democrat, sent Vermont Senator Warren Austin, a Republican, to be the first United States Ambassador to the United Nations. Ambassador Austin cast America's vote with other UN delegates to pass the Universal Declaration of Human Rights. Truman and Austin's bipartisan vision believed "it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law."

Their proclamation made the "Universal Declaration of Human Rights a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction."

Now is the time for all generations to take up this mantel for freedom and recommit ourselves to the cause of pro-empathy freedom and demand that only pro-empathy voters be allowed on any ballot of the United States of America. Pro-empathy freedom voters in and out of office are the solution to all of our issues.
