CHIEF JUDGE ANDREW OWENS: REMOVE JUDGE THOMAS GALLEN FROM BENCHWE THE UNDERSIGNED have genuine issues with senior Judge Thomas Gallen of 12th Judicial Circuit Florida. Judge Gallen has adjudicated in foreclosure hearings in Manatee County for a period much longer than the ‘temporary’ basis usually permitted for senior judges and at 82 years of age, he is considerably past the retirement age. As a “senior” judge he is not an elected official and therefore he is not accountable to the public for his actions and decisions. Court watchers have observed the following: Judge Gallen-- 1. Has stated openly in court that he has already decided the case before the attorneys are finished presenting the case-- 2. Often refuses to allow defense attorneys to have a closing argument— 3. Openly assists the bank plaintiff by questioning the defense witness himself— 4. Allows the bank plaintiff to enter paperwork outside the “4 corners of the complaint” in a Motion To Dismiss— 5. Provides case law to plaintiffs during hearings and trials to ensure that they prevail-- 6. Interprets the law differently for Plaintiffs than he does for defendants-- Judge Gallen makes decisions in foreclosure cases without regard to the evidence put before him, without regard to the relevant laws, Florida Statutes, case law and Rules of Civil Procedure. He makes decisions before the defendants have fully presented their case and attempts to prosecute cases from the bench. He is clearly prejudiced in favor of the Banks, financial institutions and unauthorized entities. When a Judge fails to judge fairly, understand the complicated and ever changing foreclosure issues, and has nothing to lose when he takes away a person’s property rights unfairly, he must be removed. Defendants do not want to present cases in front of Judge Gallen because he is biased. Judges in foreclosure cases are both judge and jury. The Constitution grants everyone due process of law. [N]or shall any State deprive any person of life, liberty, or property, without due process of law . . . Amendment V of the Constitution Where an individual is facing a deprivation of life, liberty, or property, procedural due process mandates that he or she is entitled to adequate notice, a hearing, and a neutral judge. After WV Chemical Spill, Time to Clean Up Dirty EnergyI’m from West Virginia, and the recent chemical spill breaks my heart, makes me very angry, and makes me scared for my friends and family. Imagine not being able to give your children a glass of water to drink. Imagine not being able to cook for them, or having to tell them that they can't bathe or brush their teeth because the water will make them sick. Imagine being pregnant and told that the water could be harmful to your pregnancy. It's terrifying. That’s what happened to tens of thousands of moms in West Virginia, including many of my friends, because a toxic foaming agent used in coal processing, leaked into the Elk River and contaminated the water supply for 300,000 West Virginians, cutting them off from clean water for as many as 10 days. THE RECENT SPILL IS YET ANOTHER EXAMPLE OF THE DANGERS OF RELYING ON DIRTY ENERGY! We all know it's time to make our energy cleaner and safer to protect the health of our families. Power plants produce 40% of our country's carbon pollution, which creates smog and provokes asthma at a time when one in 10 kids have it. Governor Corbett, Is Nothing Sacred? Don't Frack Our State Forests!In his budget address, Governor Tom Corbett announced plans to open up Pennsylvania's state forests to fracking. It's a short-sighted attempt to balance the state budget. Our state forests are too precious to put in the hands of drillers. And, since pollution knows no boundaries, drilling's detrimental effects would extend far beyond our forests' borders, impacting our health, safety, and economy. Public opinion polls have shown that the majority of Pennsylvanians oppose fracking on public lands, but our Governor isn't listening, so we need to get louder. Sen. McConnell: End General Electric's Tax LoopholeGeneral Electric is one of the worst corporate tax dodgers out there. It has managed to pay ZERO dollars in federal income taxes for four recent years -- thanks to some big tax loopholes and some clever accounting. The company has mobilized a small army of lobbyists in Washington this year, because one of its most profitable tax loopholes has just expired. This loophole -- known as the "active financing" loophole -- lets General Electric put off paying its U.S. taxes indefinitely when it shifts the profits it makes from interest and dividends to offshore tax havens. This one loophole will cost $70 billion over the next 10 years. Senate Minority Leader Mitch McConnell has said that a large package of corporate tax loopholes, which includes the active financing loophole, should be renewed without the cost being covered. That’s not right. Our country should not go further into debt to keep a tax loophole open for a profitable, tax-dodging corporation like General Electric.
