Narcan on Portland TriMetMy freshman year of high school, I was on the Max, when our Max was stopped for several minutes while the TriMet Safety and Response Team arrived, to help a man who has overdosed. Fortunately, the man was fine, but had there been more drugs in his system, without Narcan, he would have died in the time it took for the Safety Team to get there. I have had multiple people tell me about how they are on drugs, and have been multiple people be kicked off the Max for the illegal possession of fentanyl. Currently, the TriMet system is relying on passengers to carry Narcan and save lives. This burden should not be on children. “The number of unintentional overdose deaths related to illicitly manufactured fentanyl nearly quadrupled between 2020 and 2022, increasing from 223 to 843 overdose fatalities.” (Data source: CDC SUDORS Dashboard: Fatal Drug Overdose Data). According to the Centers for Disease Control and Prevention: • More than 645,000 people in the United States have died from overdoses involving opioids since the epidemic began; • The number of annual opioid overdose deaths remains more than six times higher than it was in 1999; • There were approximately 81,806 opioid overdose deaths in 2022 Years and 90% involved synthetic opioids other than methadone • There were nearly 290,000 hospitalizations and emergency department visits related to opioid poisoning in 2016 In 2024, a bartender named Tanaz Polson was forced to use her Narcan (that she started to carry with her after observing several previous overdoses on Public Transportation) on a man who overdosed on her Max. After giving several doses, the man ultimately passed away. The driver had originally urged the woman to wait for Emergency Services to arrive, but the brave women defied this and made an effort to save his life. Later, she described this ordeal as “traumatizing.” She believes that “If we treated addiction like we treated any other disease, cancer, diabetes- everybody would carry Narcan. The fact that drivers don’t carry it, security guards don’t carry it, is huge. Support Disability Rights to work and get lifesaving home healthcare!People with a disability do experience substantial limitations with one or more major life activities. Although we can’t do some daily living things, there are still many things we can do, including working fulltime in carefully chosen career fields. Work is a good thing! For example, when I work on a daily bases I help my community, you , and your loved ones. Plus, I pay taxes when I work so I am also not only paying towards my own program, I am chipping in to help pay your grandparents SSI and only means of income. Also, as a tax payer this is your money and I’m sure if possible you would rather give it while I am giving back. Then there is the moral reasons, no one should be forced onto the sidelines of life when they can contribute and participate in the community. Great societies care for those that can’t fully care for themselves, and we can’t continue pushing disability into poverty or forcing people to choose between staying alive or a career. Also, we are not advocating for luxury, comfort, or cosmetic services, this is all about critical lifesaving care that is… - 100% needed to live and only provided year round by Medicaid - so costly that only the top 5-10% of Americans could afford to pay themselves. Very few Americans after paying there monthly bills and essentials have an extra $4,000-5,000 of disposable income every month in their pocket. Consider your current bills and circumstances, now could you add an additional $50,000-60,000 a year to that? This is not spare change people have lying around! - not about doctor visits or pharmacy copays or the typical things you need insurance for. We do have those same things to pay as well , but this is all about very costly long term home health support services such as: day to day getting dressed, getting in and out of bed , using the rest room bowel /bladder care, things we literally can’t do nor afford out of pocket - Extremely important to know if we don’t receive these services and can’t live in the community, we must live in a nursing home where Medicaid pays the bill(Your same tax money except it costs double to pay) Most people are not familiar with or knowledgeable about the world of disability so you are likely reading this thinking.. wow this sounds backwards, outdated, and just wrong. Everyone I've talked to agrees, including the government. They understand and agree that this is a broken flawed system. Countermeasures Injury Compensation Program (CICP) needs reformThe CICP was established in 2005 under the Public Readiness and Emergency Preparedness Act (PREP Act). The CICP is codified at 42 U.S.C. §§ 247d–6e and 239a, and its implementing regulations are found at 42 C.F.R. Part 110. The CICP was created to act as a safeguard for Americans injured by medical interventions deployed in public health emergencies. In exchange for granting broad legal immunity to manufacturers,distributors, and healthcare providers under the PREP Act, Congress intended the CICP to serve as a critical safety net for those harmed by emergency-use interventions. Instead, the program has become a black hole where claims go to die, families are ignored, and the government quietly evades accountability. As of November 1, 2024, the CICP had received 13,520 claims, many from people who lost loved ones after being given COVID-19 treatments authorized for emergency use during the pandemic. Of the 3,438 claims reviewed, not a single one involving non-vaccine treatments has been approved. This is due, in part, because the CICP requires claimants prove that an authorized countermeasure was the sole cause of their loved one’s death. Such a standard of causation is virtually impossible to meet. The CICP’s shocking 0% approval rate of claimsreflects its failure to protect the very people Congress intended—families who can no longer sue due to the PREP Act. These families were told the CICP would be their only path to justice. But in reality, the system is rigged against them. One such family is that of Peter Petrassi, a 49-year-old New York City Transit conductor who served the MTA for over 20 years. In March 2020, during the height of the COVID-19 pandemic, Peter reported to work every day, helping to keep essential city services running. He was later exposed to COVID-19 and his illness worsened, compounded by the effects of treatment he received as a result of protocols in place at the time. Peter died from complications that his family believes were at least partially caused by countermeasures administered during his illness — yet his family has no legal path to compensation or accountability. Peter was the first New York City MTA worker to die during the COVID-19 pandemic but, sadly, his death was not an isolated case. A year later, 156 transit workers had died fromcomplications related to COVID-19, many of whom were hospitalized and treated using the same emergency countermeasures. Yet Peter’s family, like many others, has been shut out by the CICP, unable to meet the impossibly high bar of proving that a single drug or treatment — and not COVID-19 itself — was the sole cause of their loved one’s death. This is just one example among thousands. Behind each claim is a grieving spouse, parent, or child. These families were told to trust the government’s response to a pandemic. Many received treatments that were rushed to market under Emergency Use Authorization. Now, they are told they have no right to sue, no right to appeal, and no right to compensation because the government has protected itself and pharmaceutical companies from liability while providing a broken compensation mechanism for citizens. We need your help to bring this tragedy to the attention of the United States Congress. How has the CICP failed? - Zero transparency: Families are denied access to how decisions within the CICP are made. Secret internal guidance allegedly instructs reviewers to search for any other cause of injury or death to justify denial. - Impossible standards: The requirement to prove that the countermeasure was the sole cause of death contradicts medical reality, especially when COVID-19 was present in most cases. - No legal recourse: Once the Secretary of Health and Human Services makes a final determination regarding a claim for compensation under the CICP, there is no option for appeal, either judicial or administrative. This is violative of the fundamental right of due process. - Wasteful spending: While families receive nothing, millions of taxpayer dollars have been paid to government contractors and to cover administrative expenses of the CICP. - Complete lack of accountability: Despite these failures, the program continues to operate without reform, oversight, or pressure to improve. Call to action: Congress created the CICP to serve as a lifeline for those harmed during a national crisis. Instead, it has turned its back on them.
