FBI Director Comey Must ResignOur country depends upon agencies like the FBI to enforce the law and keep our country safe. Picking sides in a presidential election is absolutely unacceptable, and undermines not only the judicial system, but the credibility of our democracy. Our law enforcement officers must never allow themselves to be used for partisan attacks. FBI Director James Comey broke faith with the American people when he did just that. Despite an utter lack of new evidence related to any wrongdoing, Comey released a letter to Congress reigniting partisan attacks against Hillary Clinton just days before the election. It was clear from the beginning that this letter could influence the outcome on November 8th, a fact which Comey must have known, making his decision to violate long-standing DOJ policy all the more unacceptable. On Sunday, two days before the election, Comey released a second letter revealing that no new evidence had emerged and therefore his conclusions were unchanged from July - essentially admitting that his first letter was baseless. Now it's time for him to write a third letter announcing his resignation. Like the FBI, the military is expected to stay neutral in democratic elections. Veterans like me know that to take sides on partisan issues while actively serving is not just a violation of our oaths, it is an abuse of power. James Comey cannot continue serving as FBI Director, and regardless of the outcome of the presidential election, his continued presence in the job will hurt the credibility of the FBI and its relationship with the next President. In this volatile political time, we cannot allow our law enforcement agencies to become partisan tools. Please join me in calling on Director Comey to step down now. FCC: Investigate Alleged Cell Phone Jamming at Standing Rock #NoDAPLProtestors at the Standing Rock #NoDAPL protest have alleged that police have jammed their cell phone communications [1] and have spied on their communications. [2] Cell phone jamming by state or local authorities is illegal, and general surveillance of protesters without probable cause violates the Fourth Amendment. Proving or disproving allegations about jamming is very difficult for anyone except the Federal Communications Commission [FCC]. Only the FCC can work with wireless providers, protesters, and local law enforcement to find out definitively what’s going on. The FCC is the only expert agency with authority to require law enforcement to disclose their use of any wireless devices and the only agency with the expertise to assess what is actually happening. If the FCC investigates and finds that there is no illegal jamming happening, then it can settle this concern. If the FCC discovers that there is illegal jamming happening, it has an obligation to expose the jamming and use its power under federal law to order local law enforcement to stop interfering with First Amendment rights of freedom of speech and freedom of the press. [3] Congress and the President may request the FCC to take appropriate action to determine whether illegal jamming is taking place, and whether law enforcement have violated the terms of the FCC license to use IMSI Catchers ("Stingrays") by expressly requiring local law enforcement to use IMSI Catchers in accordance with due process. The Administration can order the Justice Department to investigate whether local law enforcement have violated the civil rights of the protesters through unlawful surveillance and illegal disruption of their freedom to communicate and freedom of the press under the First Amendment.
